Date set for sentencing hearing in London bush party homicide case

The sentencing of a London man who pleaded guilty to his part in the shooting death of a Lambeth teenager has been delayed until next month.

Dylan Schaap, 22, pleaded guilty in May to manslaughter in the death of Josue Silva, 18, and assault with a weapon, described as “a blunt object,” on another man, in connection with a bush party in southwest London on July 31, 2021.

Silva was shot at a gathering of young people near Pack Road and Grand Oak Crossing in a rural part of the city.

No facts have been entered in Schaap’s case and the court is still waiting for the completion of a pre-sentence report.

At a brief court hearing Tuesday, Superior Court Justice Michael Carnegie set Sept. 18 as the return date for the sentencing hearing. Victim impact statements and arguments from the Crown and defence are expected on that date.

Carnegie indicated he would reserve his sentencing decision to a later date.

Silva, a Western University student and Saunders secondary school graduate, died of a gunshot wound at the mid-summer party that was attended by dozens of young people.

An Ontario Scholar in high school, Silva had just finished his first year of business studies at Western. He had spent the summer working two jobs, often six or seven days a week, in the construction industry and at Party City, where he’d been an employee of the month.

At the time of Schaap’s guilty plea, defence lawyer Aaron Prevost described his client’s role as “party liability” to the manslaughter and “direct liability” to the assault charge.

Two other people are charged in the case and remain before the court.
